Suggestive Refusals

A suggestive mark requires thought to associate with a good or service. Suggestive marks are usually distinguished from descriptive marks by some incongruity. Suggestive marks may be registered on the Principle Registry without showing secondary meaning - a showing that the mark is already associated with a product or service. An examining attorney will typically make a determination whether a suggestive mark is in fact descriptive, or arbitrary and fanciful.
