TTAB Rulings Conclusive
The Supreme Court held that Trademrk Trial and Appeal Board (TTAB) rulings may be conclusive in subsequent trademark infringement suits in B&B Hardware, Inc. v. Hargis Industries. The two actions must be materially the same and issure preclusion requirements must be met. As a result, if the TTAB has ruled for you for likelihood of infringement, you may not need to relitigate the issue in an infringement action.
